For the Use of LuxFit Private SPA
§ 1 Scope of Application
1. These house rules govern the use of the Private SPA room and other services provided by:

1. (hereinafter referred to as “Provider”, “LuxFit Private SPA” or “we”). These provisions apply to all customers and visitors (hereinafter collectively referred to as “Users”) and serve to maintain safety, order and cleanliness at LuxFit Private SPA, particularly in the Private SPA room.
2. The house rules are binding for all users. They are accepted through online registration, or at the latest upon entering the LuxFit Private SPA room.
3. The house rules are available for inspection in the Private SPA room. These regulations supplement the Provider’s General Terms and Conditions. In the event of any contradictions, the General Terms and Conditions shall take precedence.
§ 2 Authorization to Use
1. Use of the Private SPA room is generally permitted to everyone following prior reservation and subject to capacity conditions.
2. LuxFit Private SPA reserves the right to exclude users for justified reasons, particularly those with contagious diseases, open wounds, or under the influence of alcohol or other intoxicants.
3. Access to and use of the facilities is only permitted from the age of 18. Minors are not permitted entry, even with the consent or accompaniment of their legal guardians.
§ 3 Cleaning and Vandalism
1. After each use, the Private SPA room is thoroughly cleaned and disinfected. Before each re-occupancy, staff inspect the room for vandalism damage. Any damage is documented in writing and photographically. The user is liable for any damage caused; this will be invoiced using the contact details provided at the time of booking.
2. In the event of gross contamination of the whirlpool, large pool or sauna in the LuxFit Private SPA room, the Provider is entitled to charge a separate cleaning fee. Should the cleaning work be more extensive and result in closure due to risk to other guests, the Provider will invoice the person responsible for this damage.
§ 4 Hygiene and Use of Linen
1. Users are required to wear non-slip bathing shoes in all areas of the Provider’s premises.
2. Users are required to use all seating and reclining surfaces exclusively with suitable coverings (e.g., bath towels). Towels brought by users must correspond to their body size to prevent contamination and damage. Should LuxFit determine that the towels are unsuitable, users are required to rent a suitable bath towel from LuxFit for a fee.
3. Users are expected to wear bathrobes. Bathrobes and towels can also be rented for a fee.
4. Misuse or loss of rented linen will result in liability for damages.
§ 5 Contamination and Damage
1. LuxFit’s facilities must be treated with care.
2. Damage or gross contamination is prohibited.
§ 6 User Conduct
1. The LuxFit Private SPA room is a place of relaxation and recreation.
2. Users must refrain from any behavior that violates good morals or the maintenance of safety, peace and order.
3. Sexual acts and displays are strictly prohibited. Violations of this nature, manifested in inappropriately loud behavior or indecent conduct, will result in immediate expulsion from the premises and may lead to a permanent ban.
4. Smoking is prohibited in all rooms, including e-cigarettes and similar products. Smoking is only permitted on the outdoor terrace in the designated smoking area. Smoking on the terrace in the pavilion is strictly prohibited.
5. Pets may not be brought onto the premises.
6. It is prohibited to bring or use essential oils, bath additives or similar substances, as these can damage the treatment system.
7. Mobile phones, cameras and video cameras are not permitted in the Private SPA room.
8. Consumption of food and beverages brought by users is not permitted. For hygiene reasons, consumption of food in the pools is prohibited.
9. The bubble functions may only be used when the user is in the pool.
10. Persons with long hair (shoulder-length or longer) may only use the large pool with their hair tied back using a hair tie or suitable swimming cap.
§ 7 Hygiene Standards and Water Quality
1. To meet the highest hygiene requirements for swimming and bathing facilities, LuxFit conducts monthly chemical and microbiological examinations of the bathing water in accordance with the recommendations of the Federal Environment Agency. These regular inspections ensure compliance with the strictest quality and safety standards and guarantee our guests an unimpaired bathing experience.
§ 8 Contractual Penalty and User Liability
1. In the event of violations of these house rules, particularly § 3 para. 2, § 4 para. 1, 2, § 5 para. 2 and § 6, each user is obligated to pay a contractual penalty of €350.00. LuxFit may claim a specific, higher amount of damage. The user retains the right to prove that no damage or depreciation occurred, or that it occurred only to a lesser extent.
2. Additionally, the user is liable for damages resulting from violations, such as cleaning or repair costs. The contractual penalty already paid will be credited against the damage.
§ 9 Ban from Premises
1. LuxFit, as the holder of the right to the premises, is entitled to issue a temporary or permanent ban from the premises in the event of violations of the house rules and to prohibit use of the facilities.
§ 10 LuxFit’s Liability
1. In the event of health concerns, users should seek medical advice before use. LuxFit assumes no responsibility for health damage arising from the incompatibility of the services with the user’s state of health.
2. Use of the facilities is always at the user’s own risk.
3. LuxFit is liable in accordance with statutory provisions in the event of culpable breach of duty for all damages arising from injury to life, body or health, as well as in the event of culpable breach of essential contractual obligations.
4. However, liability is limited to foreseeable, contract-typical damage, unless the essential contractual obligations were breached intentionally or through gross negligence.
5. For grossly negligent and intentional breach of non-essential contractual obligations, the Provider is also liable in accordance with statutory provisions.
6. Liability under the Product Liability Act remains unaffected. Otherwise, liability is excluded. These limitations and exclusions of liability also apply for the benefit of LuxFit’s legal representatives and vicarious agents.
7. LuxFit Private SPA assumes no liability for the loss of valuables or personal items in the Private SPA room.
§ 11 Suggestions and Complaints
1. Any suggestions or complaints should be directed to staff members, who will provide immediate assistance if possible.
2. Alternatively, feedback may be submitted in writing via email to info@luxfit.de for the attention of management.
